Terms of service
The agreement between you and us for our hosting, domains, email and services.
01About these terms
Plugmind Web is a brand of NeurodiverCity C.I.C., a community interest company registered in England and Wales (company number 13375108), at Initial Business Center, Wilson Business Park, Monsall Road, Manchester M40 8WN. In these terms "we" and "us" mean NeurodiverCity C.I.C., and "you" means the person or business ordering from us.
These terms, our Acceptable use policy and our Data processing agreement make up our agreement. If they disagree, these terms win, except on data protection, where the data processing agreement wins.
We use hosting partners to run the servers, email and domain registrations behind our services. Your agreement is with us, and we're responsible to you for the services.
02Who can order
You must be 18 or over. If you order for a business, you confirm you're allowed to agree to these terms for it.
Your account details must be accurate and kept up to date: we send notices, invoices and renewal reminders to the email address on your account.
MBA Launchpad plans are for She's In Business MBA students, with the code She's In Business gives them. We may check you're eligible, and cancel an order made without a valid code.
03Ordering
Your order is an offer to buy. Our agreement starts when we accept it and set up the service, which we confirm by email. We can turn down an order, for example if we can't verify it, and refund anything you've paid.
04Prices and paying
Prices are in pounds and exclude VAT, which we add at the rate in force.
Hosting, email and add-ons are paid monthly or yearly in advance, and renew automatically until you cancel. Domains are paid yearly (or for the period you choose) in advance, and renew automatically too.
We tell you at least 30 days before a price changes at your next renewal. If you don't want the new price, you can cancel before then. MBA Launchpad prices stay the same for as long as you keep the plan.
If a payment fails or an invoice isn't paid on time, we remind you, and may suspend the service until it's paid. A service still unpaid 30 days after its due date may be cancelled, and its data deleted. A domain that isn't renewed in time expires, and getting it back can cost a fee set by its registry.
05If you're a consumer
If you're buying as a consumer rather than for a business, you can cancel within 14 days of your order without giving a reason. If you ask us to start the service in those 14 days, we may keep a fair amount for what you've used. Domain registrations can't be cancelled once made, as they're registered in your name straight away. This doesn't affect your other legal rights.
06What's included
Each plan includes what its page and your order say, such as storage, mailboxes, websites and daily backups. How the services may be used, including fair use of processing power, is in our Acceptable use policy.
Managed WordPress and MBA Launchpad plans include the care their page describes: updates to WordPress, its plugins and themes, malware scanning and uptime monitoring. Updates can occasionally change how something on your site works; if one of our updates breaks something, we put it right.
Mailboxes that haven't been signed in to for 100 days in a row may be deleted by our hosting platform. If you keep a mailbox for forwarding only, sign in now and then.
07Keeping things running
We work to keep every service available, and post planned work and any problems on our status page. We can't promise a service will never be interrupted: hosting depends on networks, software and other companies, and some work needs a short pause.
We may move your service to different servers or IP addresses when we need to, and try to avoid any interruption. IP addresses belong to the service, not to you.
08Backups
We keep daily backups of websites and can restore one when you ask. Backups are there to help, but they aren't a guarantee: keep your own copy of anything important, which the control panel lets you download at any time.
09Support
Support is by ticket in the client area or through our contact page, and we reply within one working day. It covers the hosting itself: your services, email, domains, the control panel, and problems with our platform.
Building or changing your website, writing code and fixing third-party software aren't included, but we can quote for them.
10Domains
We register domains for you through our partners and the registry for each ending (for example Nominet for .uk). You must keep to the registry's rules, and the domain is registered in your name, with the details you give.
We email renewal reminders about 30 days and 7 days before a domain renews. We may refuse or cancel a registration the registry won't accept, or one we reasonably think is unlawful or made in bad faith.
You can move a domain away at any time once its invoices are paid: ask us for its transfer code, or for a .uk domain, the new registrar's tag change.
11Websites, moves and plugins
Work we build for you, such as a website, a move from Wix or a custom plugin, is quoted first and starts when you accept the quote. A deposit is due on acceptance, and the balance when the work is done.
If you find a fault in our work, we fix it free of charge. Changes beyond the quote are quoted separately.
When the work is paid for, it's yours to use. Themes, plugins and other software we install under their own licences stay under those licences.
12Your content
What you put on our services stays yours. You give us permission to store, copy and serve it only so we can run your services.
You're responsible for your content and how your sites and email are used, including by anyone you give access to. It must keep to our Acceptable use policy. If someone makes a claim against us because of your content or a breach of these terms, you'll cover our reasonable costs of dealing with it.
13Suspending or ending a service
We may suspend a service straight away to stop serious harm, such as malware, spam, an attack, or content that breaks the law or our Acceptable use policy. We tell you why and what's needed to restore it.
If you break these terms in another way, we'll tell you and give you 7 days to put it right before we suspend or end the service.
We can end a service for any other reason with 30 days' notice, and refund what you've paid for the time left.
14Cancelling
Cancel a service from the client area, at least 2 working days before it renews. It runs to the end of the period you've paid for, and we don't refund part periods, except as these terms say.
When a hosting or email service ends, its files, databases and mailboxes are deleted and can't be brought back. Download anything you want to keep before then.
15Our responsibility to you
We provide our services with reasonable care and skill. Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't let us limit.
Otherwise, we aren't responsible for loss of profits, revenue, business, goodwill or data, or for losses we couldn't reasonably have expected. Our total responsibility for everything under this agreement in any 12 months is limited to what you paid us in those 12 months.
We aren't responsible for delays or failures caused by things outside our reasonable control, such as attacks, power or network failures, or problems at the companies we rely on.
16Complaints
If you're unhappy with us, tell us through the client area or our contact page. We'll acknowledge it within 2 working days, look into it properly, and tell you what we'll do.
17Changes and the law
We may update these terms. For a change that affects you, we email you at least 30 days before it applies; you can cancel before then if you don't agree.
You can't pass this agreement to someone else without our agreement. If part of these terms can't be enforced, the rest still applies.
These terms are governed by the law of England and Wales, and its courts deal with any dispute. If you're a consumer living in Scotland or Northern Ireland, you can also use your local courts.
